President Stevandić sent a letter to the international members of the Constitutional Court of Bosnia and Herzegovina
The President of the National Assembly of Republika Srpska, Dr. Nenad Stevandić, today sent an official letter to the international members of the Constitutional Court of Bosnia and Herzegovina: Angelika Nussberger, Helen Keller, and Lady Bianca. In the letter, he requests them, in accordance with the Constitution of Bosnia and Herzegovina, to submit their resignations. This, he believes, will facilitate the fulfillment of one of the priorities for EU membership by the political representatives of entities and constituent peoples in Bosnia and Herzegovina.

“Honourable Judges,
In the European Commission's Opinion regarding Bosnia and Herzegovina's application for European Union membership in 2019, emphasis was placed on the condition that accession negotiations should commence once the country attains the requisite level of compliance with the membership criteria. Particularly, adherence to the political criteria outlined in the Copenhagen criteria is crucial, necessitating the stability of institutions that safeguard democracy and the rule of law, which underscores the imperative to enhance the legislative and institutional framework, thereby ensuring the realization of the 14 key priorities.
In its conclusions, adopted during the meeting on December 14 and 15, 2023, the European Council affirmed its intention to initiate accession negotiations with Bosnia and Herzegovina upon the attainment of the requisite level of compliance with the membership criteria. The Council further urged the European Commission to provide an update on the progress achieved by March 2024, facilitating an informed decision-making process by the European Council.
One of the 14 key priorities outlined in the European Commission's Opinion on Bosnia and Herzegovina's application for European Union membership pertains to the reform of the Constitutional Court of Bosnia and Herzegovina, addressing issues such as the presence of international judges and the execution of its decisions. Evidently, the presence of international judges in the Constitutional Court poses a hindrance to the country's progression in European integration and accession to the European Union. Regrettably, this priority remains unfulfilled due to the inability of political representatives from entities and constituent peoples in Bosnia and Herzegovina to reach a consensus on substituting international judges with local counterparts. Consequently, this impasse impedes the initiation of negotiations for accession to the European Union. In this context, the prevailing situation arising from the apparent stagnation in the European integration of Bosnia and Herzegovina serves as the root cause of persistent political tension among the entities and constituent peoples within Bosnia and Herzegovina.
Therefore, I invite you to submit your resignation in accordance with Article VI, paragraph 1, point c) of the Constitution of Bosnia and Herzegovina. In doing so, you would facilitate the political representatives of the entities and constituent peoples in Bosnia and Herzegovina in fulfilling this priority more easily and contribute to Bosnia and Herzegovina's progress in its path of European integration. Your resignation would demonstrate your concern for Bosnia and Herzegovina and your commitment to not impede its European future.“

Aujourd'hui, le Dr. Nenad Stevandić, Président de l'Assemblée nationale de la République de Srpska, a envoyé une lettre officielle aux membres internationaux de la Cour constitutionnelle de Bosnie-Herzégovine, à savoir Mme Angelika Nussberger, Mme Helen Keller et M. Dans l'avis de la Commission européenne sur la demande d'adhésion de la Bosnie-Herzégovine à l'Union européenne en 2019, l'accent a été mis sur la condition selon laquelle les négociations d'adhésion devraient commencer une fois que le pays aura atteint le niveau requis de conformité aux critères d'adhésion. En particulier, le respect des critères politiques énoncés dans les critères de Copenhague est crucial, car il nécessite la stabilité des institutions qui sauvegardent la démocratie et l'État de droit, soulignant l'impératif de renforcer le cadre législatif et institutionnel, garantissant ainsi la réalisation des 14 priorités clés.
Dans ses conclusions, adoptées lors de la réunion des 14 et 15 décembre 2023, le Conseil européen a affirmé son intention d'entamer des négociations d'adhésion avec la Bosnie-Herzégovine dès que le niveau requis de respect des critères d'adhésion sera atteint. Le Conseil a en outre exhorté la Commission européenne à faire le point sur les progrès réalisés d'ici mars 2024, facilitant ainsi un processus décisionnel éclairé de la part du Conseil européen.
L'une des 14 priorités clés exposées dans l'avis de la Commission européenne sur la demande d'adhésion de la Bosnie-Herzégovine à l'Union européenne concerne la réforme de la Cour constitutionnelle de Bosnie-Herzégovine, abordant des questions telles que la présence de juges internationaux et l'exécution de ses décisions. De toute évidence, la présence de juges internationaux à la Cour constitutionnelle constitue un obstacle à la progression du pays vers l'intégration européenne et l'adhésion à l'Union européenne. Malheureusement, cette priorité n’est toujours pas réalisée en raison de l’incapacité des représentants politiques des entités et des peuples constitutifs de Bosnie-Herzégovine à parvenir à un consensus sur le remplacement des juges internationaux par leurs homologues locaux. Par conséquent, cette impasse entrave l’ouverture des négociations d’adhésion à l’Union européenne. Dans ce contexte, la situation actuelle résultant de la stagnation apparente de l’intégration européenne de la Bosnie-Herzégovine est à l’origine des tensions politiques persistantes entre les entités et les peuples constitutifs de la Bosnie-Herzégovine.
Par conséquent, je vous invite à présenter votre démission conformément à l'article VI, paragraphe 1, point c) de la Constitution de Bosnie-Herzégovine. Ce faisant, vous aideriez les représentants politiques des entités et des peuples constitutifs de Bosnie-Herzégovine à réaliser plus facilement cette priorité et contribueriez aux progrès de la Bosnie-Herzégovine sur la voie de l'intégration européenne. Votre démission témoignerait de votre préoccupation pour la Bosnie-Herzégovine et de votre engagement à ne pas entraver son avenir européen."
