• Joint Comission

    The Joint Commission is formed by five representatives each from the National Assembly of The Republic of Srpska and the Council of Peoples of The Republic of Srpska.

    The method of forming the part of the Joint Commission is regulated by the National Assembly and the Council of Peoples through their own acts (Rules of Procedure).

    The session of the Joint Commission is convened, chaired, and the agenda is proposed by the President of the National Assembly or the Chairman of the Council of Peoples, and this is done alternately: the President of the National Assembly in the period from January 1 to June 30, and the Chairman of the Council of Peoples from July 1 to December 31 of each year in the mandate period.

    The Joint Commission makes decisions by consensus.

    The Joint Commission harmonizes the text of laws, other regulations, and acts adopted by the National Assembly if they fall under issues of vital interest or if amendments have been submitted to them on which agreement was not possible in the Council of Peoples.

    If the Joint Commission reaches an agreement, the act is considered adopted and is published in the Official Gazette of The Republic of Srpska.

    If the Joint Commission does not reach an agreement, the issue is forwarded to the Constitutional Court – Council for the Protection of Vital Interest to make a final decision on whether the subject law, amendment, other regulation, or act relates to the vital interest of one of the constituent peoples.

    If the Constitutional Court – Council for the Protection of Vital Interest makes a positive decision regarding the vital interest, that law is considered not adopted, and the document is returned to the proposer who must initiate a new procedure; and if the Court decides that the subject law does not relate to the vital interest, the law is considered adopted and is published in the Official Gazette of The Republic of Srpska.
